Alternative Dispute Resolution
Global Claims Associates offers a unique Alternative Dispute Resolution service for conflicts resulting from jewelry and personal property related commerce and insurance claims. This includes disputes between jeweler and dealer, consumer and jeweler, and consumer and insurance company, among others. Our services also include serving as appraiser or umpire in insurance claims where the insured has invoked the Appraisal and Umpire Clause contained in most insurance policies. We have successfully resolved insurance claims disputes for major insurance companies and have many years of experience working with law firms regarding mediation and arbitration of high value jewelry and gemstone disputes.
Alternative Dispute Resolution is a method of resolving conflicts without the high cost in time and money of litigation by allowing an impartial third party to help resolve the dispute through mediation or arbitration. Mediation is a non-binding agreement by both parties to allow the mediator to help find a resolution. Binding Arbitration is where both parties agree to be bound by the Arbitrator’s final decision. Both sides are allowed to present their evidence, state their cases, and present any additional information that they feel is relevant to their position in the dispute. The impartial Mediator or Arbitrator works to resolve the issue by weighing the evidence presented.
Global Claims Associates was founded in 2004 by Robert James FGA, GG, after many years working in the Property and Casualty Department of USAA Insurance. The GCA is a member of the National Association of Independent Insurance Adjusters, the Insurance Appraisal and Umpire Association, and Robert James is an Associated Professional Member of the American Bar Association. He is a member of the Section of Dispute Resolution of the ABA.
